In this short course, we strive to empower aspiring lawyers with the skills that they require to manage their profession beyond the theoretical knowledge received during their law degrees.

The course covers the following core topics that are relevant to candidate attorneys and junior attorneys. These are:

  • Understanding the foundational principles of legal summonses, encompassing drafting techniques and the selection criteria for appropriate usage.
  • Mastering the fundamentals of drafting a notice of motion, covering its structural components and procedural significance.
  • Exploring the essentials of drafting particulars of claim, including its role as a crucial attachment to summonses and its overarching purpose in legal proceedings.
  • Exploring the fundamentals of crafting heads of argument, understanding the contexts in which they are required and their strategic importance.
  • Developing proficiency in drafting a plea in civil claims, recognising its pivotal role and the necessary elements for its effectiveness.
  • Understanding the fundamentals of a counterclaim, including its rationale and strategic timing within legal proceedings.
  • Gaining insight into the nature of legal opinions, including the requisite drafting skills to produce thorough and coherent assessments.
  • Acquiring the skills to incorporate legal court judgments effectively into the process of writing legal opinions, ensuring accuracy and relevance.
  • Recognising the importance of employing plain language in legal drafting, mastering the art of substituting technical jargon with clear and formal terminology.
  • Understanding the distinction between standard correspondence and legal letters, appreciating the unique characteristics and requirements of the latter within legal practice.

About the Presenters

Lisa Thomas

Adv Lisa Thomas is a former criminal defence advocate and in-house counsel in Durban, Lisa has seen the law practice from both sides. She graduated with her LLB, completed her pupillage, and was admitted as an advocate in 2008. Her current area of interest is in alternative dispute resolution, specifically mediation. She is a maverick for humanity and ethics within the legal profession in South Africa with a focus on candidate attorneys
