About This Course

This course will provide a comprehensive and practical understanding of the legal principles and case law relevant to the workplace. The course will be a valuable resource to those managing human resources, fulfilling the complex role of labour relations as well as lawyers advising in the sector. The course will take attendees through the lifecycle of employment from recruitment to termination.

The course will ensure that attendees are able to draft and interpret contracts of employment and ensure compliance with the Basic Conditions of Employment Act and recent amendments.

Attendees will gain valuable skills in chairing and prosecuting disciplinary hearings in line with the Labour Relations Act and the recently amended Code of Good Practice: Dismissal, 2025.

The course will also provide attendees with an overview of dispute resolution mechanisms applicable to labour law namely the CCMA, Bargaining Councils and the Labour Court. The course will prepare attendees with the skills to prepare for cases at the CCMA and effectively use conciliation and put your best foot forward at arbitration. This module will conclude with an overview of which matters are dealt with at the Labour Court as well as an overview of changes to the Labour Court practice as we enter a new era of virtual courts.

Promoting compliance and ensuring workplace harmony, the course will provide an overview of the 2022 Code of Good Practice on the Prevention and Elimination of Harassment. This valuable topic will place attendees in good stead to advise on how to mitigate against risks stemming from discrimination.

The course will also look at how social media and AI are being managed in the workplace. This course will look at how social media misuse has been addressed by the Courts and guidelines into fair social media use. The course will conclude with global comparative guidelines on the use of AI in the workplace and what the future holds.


Competencies Developed in this Short Course

After successful completion of this course, you should be able to demonstrate the following competencies:

  • Contract Drafting and Interpretation: Draft and interpret contracts of employment that comply with the Basic Conditions of Employment Act, the Labour Relations Act and recent amendments.
  • Dismissals – Substantive and Procedural Fairness: Distinguish fair from automatically unfair dismissals and apply the correct substantive and procedural fairness tests.
  • Disciplinary Hearings: Chair and prosecute disciplinary hearings in line with the Labour Relations Act and the Code of Good Practice: Dismissal, 2025.
  • CCMA and Bargaining Council Dispute Resolution: Prepare cases for conciliation and arbitration at the CCMA and Bargaining Councils, including preliminary points and referrals.
  • Labour Court Practice: Determine which matters fall within the Labour Court's jurisdiction and apply the 2024 amendments to the Labour Court Rules, including in a virtual court environment.
  • Prevention of Workplace Harassment: Apply the 2022 Code of Good Practice on the Prevention and Elimination of Harassment to reduce discrimination risk in the workplace.
  • AI and Social Media Governance: Regulate the use of AI and social media in the workplace in line with current case law and comparative guidelines.

Course Delivery, Duration, and Effort

This 3-month course is delivered through the SA Legal Academy online learning campus. The course is divided into 7 modules. In this way you can maintain a work-life balance whilst studying and improving your professional skills. The required effort is 4 to 8 hours per week.

About the Presenter

Chantelle de Sousa

Chantelle de Sousa has been an instructor with the South Africa Legal Academy since 2023 and regularly presents on topics related to Labour Law. Chantelle has been practising law since 2011 and read for the BCom LLB (North West University) and LLM (SOAS, University of London). She advises both public and private sector employers and employees and regularly chairs and prosecutes disciplinary hearings. She has represented clients at the CCMA, various Bargaining Councils and Labour Court.

This course includes formative assessments to test your knowledge throughout the modules. Learners must achieve all competencies of the course.
