The regulatory landscape governing beneficial ownership in South Africa has evolved into a strict compliance framework. Under the General Laws Amendment (Anti-Money Laundering and Combating Financial Terrorism) Act 22 of 2022, regulatory authorities have significantly increased their oversight of companies, close corporations, and trusts. Practitioners, directors, and trustees face severe professional exposure and administrative penalties if they fail to maintain accurate, up-to-date beneficial ownership records or fail to execute mandatory filings.

This webinar addresses the practical interplay between the Companies Act 71 of 2008 (specifically regarding the CIPC’s beneficial ownership register and hard-stop annual return blockages) and the Trust Property Control Act 57 of 1988 (detailing the Master of the High Court’s strict registration demands). Legal professionals must move beyond simple compliance checklists to actively analyse complex, layered ownership structures—such as trust-held shareholdings and foreign beneficial owners—to shield clients from regulatory rejections and personal liability.

About the presenter 

Adv. Dwight Snyman 

Adv. Dwight Snyman is an admitted member of the Johannesburg Society of Advocates and is accredited by the Legal Practitioners Council as an Advocate of the High Court of South Africa. Adv. Snyman completed articles of clerkship, and attorney’s competency exams under the auspices of the Wits Law Clinic. He completed his Advocacy pupillage under the tutelage of the esteemed Adv. Louis Du Bruyn. 

Adv. Snyman has had opportunity and success in litigation, in the High and Magistrates’ Courts of the republic, the CCMA, Disciplinary Hearings and assorted other venues and forums, and has become possessed of practical litigation experience beyond what would normally be expected from a practitioner of his age and seniority. He is the holder of a degree in Politics, Philosophy and Economics (PPE) from the University of Cape Town, and postgraduate Bachelor of Laws (LLB) from the University of the Witwatersrand, for which he was accorded the honour of being on the Dean’s list for his academic performance.
