Overview
In a world where thousands of people are still dying from Covid 19 daily, it seems Covid is here to stay unless we can get herd immunity. In South Africa, mandatory vaccinations are on the way. Employers have to make the workplace safe whereas employees have the constitutional right to work. So what happens to you as an employee where you do not want to be vaccinated but your employer has a policy in place declaring that you have to vaccinate or be dismissed. What happens if you refuse to work as other employees at the workplace are still not vaccinated? Would this be a legitimate grievance?
What happens when an employee resigns with immediate effect? Can he be sued by the employer for not giving notice, can you deduct money owed from his final pay-check or even refuse to pay him? Also, what is the employee entitled to?
Employment Law is an ever-changing dynamic field of law where cases make law. Let us take you through some of the recent cases making headlines including those on Sexual Discrimination, Covid and even what to do when your employer fails to pay you your salary.
