Overview

The Labour Relations Act provides for simple procedures for the resolution of labour disputes through statutory conciliation and arbitration. In this webinar we will discuss how to prepare for conciliation and arbitration at the CCMA and Bargaining Councils in respect of unfair dismissal disputes.

We will look at how you can make the best use of the conciliation process and how to approach settlement. A dispute can be settled amicably without fighting to the death and saving the parties time and money.

We will then turn to arbitration and make sure you are prepared to best utilise the process. How do you prepare your documentation and witnesses and convince a commissioner of your case?   • Time periods in filing disputes to the CCMA and Bargaining Councils;
  • Applying for condonation of the late filing of a dispute;
  • Preliminary issues such as jurisdiction of the CCMA;
  • Applying for legal representation;
  • How to prepare for arbtiraiton including evidence such as documentation and evidence.
  • How to lead evidence and how to cross examine
  • How to prepare closing arguments. 

About the presenter:

Chantelle de Sousa Attorneys is a law firm dedicated to providing cost-effective and efficient all-round labour law services. Chantelle read for the BCom (Law and Economics) and LLB degrees at the North-West University (Potchefstroom) and the LLM (Human Rights, Conflict and Justice) at the School of Oriental and African Studies, University of London. Chantelle was admitted as an attorney of the High Court of South Africa in March 2011 Chantelle has worked in various areas of law including intellectual property and human rights in both Europe and the rest of the SADC region. She eventually settled in the field of labour law and has worked with employers, employees and trade unions in the South African labour space. She has an excellent network in the SADC region made up of lawyers, business and civil society. She is fluent in English, Afrikaans and Portuguese.
