Overview

Recent decisions from the CCMA and Labour Courts offer some food for thought for legal practitioners, human resource and labour relations personnel. This webinar will get you up to speed with the latest interesting cases. When faced with fraud by an employee, often employers dismiss the employees and “let bygones be bygones”. However, Umgeni Water v Naidoo, demonstrates some of the redress available to employers to recoup losses and hold employees accountable.

In Ashton International v Erasmus, practitioners are reminded of the perils of “cut and paste” restraint of trade provisions and trying to enforce it in court. This reminder presents the perfect opportunity to clean up your contracts of employment and perfect your drafting skills.

Even though COVID may seem a distant memory, mandatory vaccination policies are still being decided at the CCMA and Labour Court. The webinar will give an overview of the decisions to date and how to prepare if your case has still to be decided. About the presenter:

Chantelle de Sousa Attorneys is a law firm dedicated to providing cost-effective and efficient all-round labour law services. Chantelle read for the BCom (Law and Economics) and LLB degrees at the North-West University (Potchefstroom) and the LLM (Human Rights, Conflict and Justice) at the School of Oriental and African Studies, University of London. Chantelle was admitted as an attorney of the High Court of South Africa in March 2011 Chantelle has worked in various areas of law including intellectual property and human rights in both Europe and the rest of the SADC region. She eventually settled in the field of labour law and has worked with employers, employees and trade unions in the South African labour space. She has an excellent network in the SADC region made up of lawyers, business and civil society. She is fluent in English, Afrikaans and Portuguese.
