AARTO ACT IN FORCE NATIONWIDE FROM JULY 2024?

According to Transport Minister Sindisiwe Chikunga, the Administrative Adjudication of Road Traffic Offences (AARTO) Act, 1998, as amended, will be fully operationalised on 1 July 2024.

In a recent media statement, the Minister said she expects this to make a ‘telling difference’ by ‘introducing severe penalties’ intended to end the prevailing ‘culture of impunity’. In addition to a points demerit system, penalties apparently include ‘attaching (the) movable properties of infringers’.

In anticipation of the Act’s commencement nationwide, the Department of Transport has:

  • completed its work on the required ‘adjudication process’
  • established a system for ‘the electronic service of infringements
  • drafted regulations in liaison with the Department of Justice & Constitutional Development and on which provincial concurrence is being finalised, and
  • prepared ‘recommendations to the President for the appointment of the tribunal’.
