Presidential proclamations have been gazetted withdrawing those issued on 1 August 2025 to announce the commencement of various sections of the 1998 Administrative Adjudication of Road Traffic Offences (AARTO) Act and 2019 amendment Act. Implementing regulations gazetted on 31 October 2025 have also been withdrawn.
This follows a decision announced in a media statement issued on 11 November 2025, deferring to 1 July 2026 the 1 December 2025 commencement of the phased AARTO implementation process.
According to the statement, a recently conducted readiness assessment found ‘some of the municipalities that were to (have) form(ed) part of the first implementation phase’ needed more time to:
Interestingly, not one of the withdrawal notices refers to 1 July 2026 as the date on which AARTO’s phased implementation is now expected to begin. All four notices were published on 1 December 2025 and backdated by three days.
