The 2023 Agricultural Product Standards Amendment Act is now in force, according to a presidential proclamation published in the Government Gazette.
Addressing ‘various deficiencies’ in the 1990 principal statute, the amendment Act is expected to facilitate the ‘clear and effective application of management control’. This is according to a memorandum on the objects of the Bill concerned, which was passed by Parliament in November 2023. To that end, the new piece of legislation provides for product auditing for quality control purposes.
Apparently, a ‘key deficiency’ in the principal statute is its definition of the term ‘management control system’, which covers all management systems pertaining to inspection, auditing and production practices and was found to have been incorrectly captured. The amending legislation rectifies this so that the provisions concerned ‘fully address what was (originally) intended’.
