AIR QUALITY: 2013 DUST CONTROL REGULATIONS REPLACED

The Department of Forestry, Fisheries & the Environment has gazetted revised dust control regulations applicable nationally under the 2004 National Environmental Management: Air Quality Act with immediate effect. Released in draft form in March 2024 for public comment, they repeal those in place since October 2013.

Among other things, the new regulations allow affected parties 60 days to prepare and submit dust management plans. With that in mind, they prescribe:

  • the criteria to be met when developing a plan
  • the contents of a plan
  • monitoring and reporting on its implementation, and
  • reviewing a plan for re-submission in terms of transitional arrangements set out in the new regulations.

Provision is also made for:

  • dust fall test methods
  • dust fall rates, and
  • offences and penalties.
