B-BBEE: BRIEFING PATTERNS TO BE MONITORED – MINISTER

Justice & Constitutional Development Minister Mmamoloko Kubayi has drawn attention to the role of the newly established Legal Sector Code Charter Council in ongoing efforts to improve the participation of historically disadvantaged legal practitioners and law firms in sector-specific briefing and related work opportunities. During a question-and-answer session in the NCOP, the Minister told members that – among other things – ‘with the assistance of the Solicitor General’s office’ the Charter Council will monitor:

  • ‘legal outsourcing targets for private and public institutions’, along with
  • public and private sector briefing patterns.

According to a memorandum to ‘legal practitioners and stakeholders’ apparently circulated on 22 April 2025 in De Rebus, the Charter Council was formally established ‘at the beginning of March 2025’. This followed the publication of a broad-based black economic empowerment (B-BBEE) legal sector code of good practice on 20 September 2024, as SA Legal Academy reported at the time.
