B-BBEE: MARKETING, ADVERTISING & COMMUNICATIONS CODE TO BE REVISED

Minister in the Presidency, Mondli Gungubele, has issued a media statement drawing attention to a Government Gazette notice published on 30 December 2022, the heading of which called for comments on a revised broad-based black economic empowerment code for the marketing, advertising and communications sector. However, the revised code was never made available. Neither was a deadline set for stakeholder input.

In fact, the notice itself tended to suggest that public comments were being sought on the 2016 code in anticipation of its impending review. This was noting the importance of aligning the 2016 code with amendments made in May 2019 to the generic code and three related statements.

The Minister’s press release refers to a series of public hearings apparently already conducted this year as part of the review process. It also mentions what appears to be an ongoing opportunity for ‘written and oral inputs’. Clarity is needed.
