BASIC CONDITIONS OF EMPLOYMENT ACT: EARNINGS THRESHOLD ADJUSTMENT IMMINENT

The Department of Employment & Labour has gazetted a notice adjusting the earnings threshold above which certain provisions in the Basic Conditions of Employment Act, 1997, will soon no longer be applicable. From 1 April 2024, the new earnings threshold will be R254, 71-67 per annum – excluding certain deductions and employer contributions stipulated in the notice.

Sub-section 6(3) of the Act empowers the Minister to determine to which category of employees specific working time regulatory prescripts should not apply – based on their earnings.
