BORDER MANAGEMENT AUTHORITY: NEW REGULATIONS GAZETTED

The Department of Home Affairs has gazetted new regulations under the 2020 Border Management Authority Act – repealing and replacing those in force since June 2025. In the absence of an accompanying memorandum or media statement, it is not clear why this was deemed necessary.

Immediately effective, the new regulations focus on personnel and administrative matters, covering the same issues as the 2025 version, namely:

• the structure and functioning of the border guard as an entity
• a clause prohibiting officials from directly or indirectly conducting business with the Border Management Authority itself or any other organ of state
• the deed of officer commission
• the declaring of allegiance by a commissioned officer
• officer training
• commissioned officer training
• arming and equipping officers
• ranking officers
• officials’ security grades
• officials’ qualifications and experience
• identity cards
• a clause prohibiting officials from conducting remunerative work outside the Border Management Authority unless authorised to do so
• the code of conduct
• sanctions for misconduct
• advisory committee meeting rules and procedures
• matters relating to the National Border Targeting Centre as a unit with the Border Management Authority
• reviewing or appealing decisions
• complaints and grievances affecting the work of the Border Management Authority, and
• designating ports of entry or exit.
