ICT INVESTMENT & B-BBEE: DRAFT POLICY DIRECTION OUT FOR COMMENT

The Department of Communications & Digital Technologies has called for input by 22 June 2025 on a draft policy directive to be issued under the 2005 Electronic Communications Act with the intention of:
- ‘clarify(ing) (its) position on broad-based black economic empowerment (B-BBEE), including the recognition of equity equivalent investment programmes’, and
- requiring the Independent Communications Authority of South Africa to ‘implement certain amendments to regulations promulgated by it in order to meet the imperatives of other national laws’.
This is noting government’s ongoing commitment to:
- facilitating broadband rollout
- bridging the digital divide
- encouraging strategic infrastructure and other investment
- promoting innovation and competition, and to
- ‘promot(ing), facilitate(ing) and harmonis(ing) the achievement of the objects of all other legislation related to the Act.
Against that backdrop, reference is made to the importance of regulatory certainty and consistency in the context of the 2016 amended ICT sector B-BBEE code of good practice.
