BUILT ENVIRONMENT PROFESSIONS: IMPROPER CONDUCT INQUIRY RULES OUT FOR COMMENT

Please note: Both draft documents were regazetted two days before the commentary deadline expired – and for a third time on 14 December 2023, when the deadline was extended to 15 January 2024 (as reflected on the penultimate pages of Government Gazette 49863, Board Notices 536 and 535). 

The South African Council for the Project & Construction Management Professions has called at rather short notice for input on two sets of draft rules. One deals with inquiries into allegations of improper conduct by registered built environment professionals – and the other with reregistration. They were gazetted nine days before the commentary deadline, which is 10 December 2023.

Confirming that the Council may only investigate alleged contraventions of its 2017 revised code of conduct, the draft rules on inquiries provide for whistleblowing using the Council’s fraud hotline – subject to the prescripts of the Protected Disclosures Act, 2000.

The draft rules for reregistration include disqualification conditions, one of which is ‘removal from an office of trust on account of improper conduct’.
