CANDIDATE ATTORNEY AND PUPILLAGE REMUNERATION PROPOSALS OUT FOR COMMENT

The Legal Practice Council has gazetted a notice calling for input by 11 September 2023 on minimum remuneration proposals for:

  • candidate attorneys under practical vocational training contracts, and
  • those in pupillage under the supervision of practising advocates.

The proposal for candidate attorneys takes account of:

  • the different conditions and challenges faced when contracted to firms in urban and rural settings
  • the prevailing economic climate, and
  • the ‘diversity of law firms taking on candidate legal practitioners’.

Bearing in mind that, according to the notice, pupils are not employees, it is proposed that:

  • a levy should be imposed on practising advocates, and
  • a fund established from which pupils are then remunerated.
