CANNABIS FOR PRIVATE PURPOSES ACT: INPUT SOUGHT ON DRAFT REGULATIONS

The Department of Justice & Constitutional Development has called for input by 5 March 2026 on draft regulations under the 2024 Cannabis for Private Purposes Act.
In anticipation of the Act’s commencement, once finalised and in force the proposed new regulations will prescribe:
- the maximum:
- amount of cannabis one person may possess in a ‘private or public place’
- number of cannabis plants one person may possess ‘for cultivation in private’, and
- amount of cannabis one person may transport
- transport-related conditions, restrictions, prohibitions, obligations, requirements and standards (including those associated with passengers in any vehicle transporting cannabis)
- procedures to be followed when applying for the expungement of a cannabis-related criminal record
- the contents of a criminal record expungement certificate, and
- related procedures to be followed by the South African Police Service.
