CHILD CARE FACILITIES: DA DRAFTS BILL TO REGULATE MICRO SERVICE PROVIDERS

The DA’s Bridget Masango has called for input by 18 June 2023 on the contents of a Bill to regulate partial care facilities catering for six children or fewer.

Under the prevailing legislation – and apparently in an attempt not to ‘over-burden’ such facilities with regulatory red tape – they are not required to be registered or to comply with structural safety, health and other norms and standards. This is according to an explanatory summary of a draft Children’s Amendment Bill that would seek to address this situation by providing for the registration of ‘micro partial care facilities’ and a once-off inspection.

Masango believes the minimal regulatory requirements envisaged would go some way towards preventing children from being left for certain hours of the day or night in ‘deplorable conditions’ not only violating the Children’s Act itself but also the Constitution.
