CHILDREN’S COURTS: DRAFT RULES RELEASED FOR COMMENT

The Rules Board for Court of Law has called for input by 28 February 2025 on draft Children’s Court rules and associated forms, which are underpinned by 2005 Children’s Act prescripts and related regulations.
According to a memorandum on the objects of the rules envisaged, once finalised and in force they are expected to ‘establish uniformity in the processes and procedures’ of Children’s Courts nationwide. This is noting differences or contradictions in among stakeholders interpreting regulations under the Act.
Informed by input received during a comprehensive consultation process, the proposed new rules also seek to improve access to the Children’s Courts and create apparently much-needed legal certainty among stakeholders.
