CIVIL AVIATION: 2021 AMENDMENT ACT IN FORCE

A recently gazetted presidential proclamation has announced the commencement of the 2021 Civil Aviation Amendment Act – effective from 12 October 2026.

According to a memorandum on the objects of the 2018 Bill concerned, the new piece of legislation is expected to ‘ensure the proper implementation’ of provisions in the principal statute intended to provide for safety, security and the investigation of civil aviation incidents and accidents. At the time, this was noting that ‘most provisions’ in the 2009 Act’s Chapter 4 (establishing a safety investigation board) ‘were never promulgated’ – largely because of the ‘practical difficulties’ entailed.

The amendment Act remedies this, among other things by providing for a range of administrative, management and governance arrangements and obligations.

In addition, the new piece of legislation:

  • amends provisions in the principal statute dealing with appeals, and
  • authorises the Minister to:
    • issue exemptions, and
    • prescribe additional offences, and to
    • prescribe additional enforcement mechanisms.
