CIVILIAN SECRETARIAT FOR THE POLICE SERVICE: STOCK THEFT, 2ND-HAND GOODS BILLS OUT FOR COMMENT

The Civilian Secretariat for the Police Service has gazetted notices calling for input by 2 November 2026 on two proposed new pieces of legislation:
- a draft Second-hand Goods Amendment Bill, and
- a draft Stock Theft Amendment Bill.
According to the notice concerned, among other things the draft Second-hand Goods Amendment Bill seeks to:
- facilitate access to a valid business visa by any qualifying foreigner intending to register as a dealer
- ensure that jewellers ‘do not acquire unwrought metal directly from unlicensed producers’
- enable persons under the age 18 years to pawn goods, subject to authorisation
- exempt non-profit organisations registered under the 1997 Non-profit Organisations Act from certain provisions in the principal statute, and
- close gaps in the prevailing legislation regarding:
- registration requirements
- obligations under the 2013 Protection of Personal Information Act
- auctioneers dealing in second-hand goods
- vehicle-related microdot particulars
- second-hand communication equipment
- routine inspections, and
- search and seizure.
The draft Stock Theft Amendment Bill seeks to:
- align the 1959 Act with constitutional imperatives and technological developments
- further regulate the possession, ownership and movement of livestock within South Afra’s borders, and
- futureproof the Act by providing for the more effective monitoring of the conveyance and transportation of stolen stock and produce.
