COMMERCIAL FISHING AND FISH PROCESSING: DRAFT POLICIES OUT FOR COMMENT

The Department of Forestry, Fisheries & the Environment has gazetted two draft fisheries sector policies for comment by 4 December 2024. One deals with the transfer of commercial fishing rights and should be read with the 2021 general policy on commercial fishing rights allocation, along with related species-specific policies. The other focuses on the allocation and management of rights to operate a fish processing plant.

Backdated to 1 November 2024, the proposed new policies were gazetted three days later, reducing the public commentary period.

Once finalised, the draft policy on transferring commercial fishing rights:

  • will repeal one in place since 2009, among other things with the aim of:
    • curbing practices undermining transformation, including ‘fronting’, and
    • addressing ‘the undue concentration of rights … (in) the hands of one entity’.

The draft policy on allocating and managing fish processing plant operating rights is underpinned by the following imperatives:

  • transformation and equitable access
  • food security
  • poverty alleviation and socio-economic development
  • the ecologically sustainable use of marine living resources
  • ensuring minimal marine pollution, and
  • meeting related international obligations.

With that in mind, among other things it deals with:

  • the factors to be considered when evaluating a fish processing rights application
  • the process of granting these rights, their duration and transfer
  • environmental authorisation
  • health and safety authorisation
  • environmental and land use planning obligations, and
  • appeals.
