COMMISSIONS OF INQUIRY: CRIMINAL JUSTICE SYSTEM, TRC CASE-RELATED ToRs AMENDED

Please note: 1) On 9 July 2026, the Presidency issued a media statement extending the Madlanga criminal justice system inquiry reporting deadline to 16 November 2026. 2) On 21 September 2026, a backdated media statement posted on the Presidency website announced yet another extension to the reporting deadline: 25 January 2027. Apparently, this one is ‘final’.   

More amendments have been made to the terms of reference for two presidential commissions of inquiry. According to the Government Gazette proclamations concerned:

• the Madlanga inquiry into criminality, political interference and corruption in the criminal justice system now has:
  • until 31 August 2026 to submit a final report, and
  • a further 60 days to wind down its operations as prescribed, while
• the Khampepe inquiry into allegations of ‘efforts or attempts to stop the investigation or prosecution of Truth & Reconciliation Commission cases’ has:
  • until 31 December 2026 to submit a final report, and
  • a further 60 days to wind down its operations as prescribed.

In addition, the Madlanga inquiry regulations on search and seizure have been amended to allow persons authorised by the chairman to issue directives.
