The Department of Agriculture, Land Reform & Rural Development has gazetted draft regulations under the 1996 Communal Property Associations Act, calling for input by 7 September 2025. Once finalised, they will repeal those in place since November 1996.
In terms of the Act, a communal property association is one formed in the context of land restitution.
Among other things, the proposed new regulations cover:
- registering a ‘communal property body’ and related documentation
- the registrar’s obligations regarding the register and its maintenance
- access to information and copies of documents
- the requirements of an association’s mandatory constitution
- the requirements of the mandatory land plan
- the role of an association’s committee
- the role of association members
- membership termination
- exemptions from land-related legislation
- deregistration and name change, and
- appeals.
