COMMUNAL PROPERTY ASSOCIATIONS: 1996 REGULATIONS TO BE REPLACED

The Department of Agriculture, Land Reform & Rural Development has gazetted draft regulations under the 1996 Communal Property Associations Act, calling for input by 7 September 2025. Once finalised, they will repeal those in place since November 1996.

In terms of the Act, a communal property association is one formed in the context of land restitution.

Among other things, the proposed new regulations cover:

  • registering a ‘communal property body’ and related documentation
  • the registrar’s obligations regarding the register and its maintenance
  • access to information and copies of documents
  • the requirements of an association’s mandatory constitution
  • the requirements of the mandatory land plan
  • the role of an association’s committee
  • the role of association members
  • membership termination
  • exemptions from land-related legislation
  • deregistration and name change, and
  • appeals.
