COMMUNICATIONS: DRAFT SIGNAL DISTRIBUTION REGULATIONS OUT FOR COMMENT

The Independent Communications Authority of South Africa has gazetted draft terrestrial signal distribution regulations intended to address ineffective competition and associated market failures identified during an inquiry begun in September 2021 and concluded three years later. The deadline for input is 27 February 2026.

Possibly informed by comments on an earlier set of proposals released in May 2025, among other things the draft regulations seek to:

  • impose appropriate pro-competitive licence conditions on licensees with ‘significant market power’, and
  • provide for:
    • periodic market reviews, and
    • the monitoring and investigation of anti-competitive behaviour.

The proposed new regulations focus on requirements to be met by Sentech SOC Ltd in its capacity as wholesale signal distributor to terrestrial TV, AM sound and FM sound broadcasting services, as well as ‘common carrier’ to the licensees concerned.
