The Department of Trade, Industry & Competition has gazetted amendments to regulations under the Companies Act, 2008, aligning them with requirements in the General Laws (Anti-Money Laundering & Combating Terrorism Financing) Amendment Act, 2022. They came into effect on 24 May 2023.
Released in draft form in March 2023 for comment, among other things the amendments affect:
- information verification
- record-keeping
- disclosing beneficial interests
- documents to accompany annual returns, and
- access to annual returns and related documentation.
