COMPENSATION FOR OCCUPATIONAL INJURIES & DISEASES AMENDMENT ACT GAZETTED

The Compensation for Occupational Injuries & Diseases Amendment Act, 2022, has been gazetted but is not yet in force. Tabled in Parliament in September 2020 and passed two years later, the Bill giving rise to the amendments concerned was signed into law on 6 April 2023.

Among other things the new piece of legislation qualifies domestic workers for benefits under the Act. It also introduces a process of rehabilitation, reintegration and return to work for those affected by an occupational injury or disease.

According to a memorandum on the objects of the Bill tabled in 2020, before terminating the employment of anyone with a workplace-related injury or disease, an employer will be expected to ‘exhaust all rehabilitation and reintegration processes’. In that regard – presumably by way of regulations – employers will be ‘incentivised’ to comply fully with the new Chapter VIIA inserted into the principal statute by the amendment Act.
