COMPETITION ACT: INPUT SOUGHT ON HEALTHCARE SECTOR BLOCK EXEMPTION

The Department of Trade, Industry & Competition has gazetted proposals with positive implications for healthcare sector collaboration. The deadline for input is 16 March 2025.
It is envisaged that, once in force, a block exemption from certain sections of the 1998 Competition Act will facilitate access to ‘affordable, quality healthcare services’ across schemes with prescribed and non-prescribed minimum benefits. This by reducing costs and discouraging the ‘overutilisation of healthcare services’.
To that end, the exemption would allow the collective determination of:
- healthcare service tariffs
- standardised diagnosis, procedure, medical device and treatment codes
- quality measurements/metrics
- medicine ‘formularies’, and
- treatment protocols/guidelines.
