COMPETITION COMMISSION: DRAFT GUIDELINES ON CONFIDENTIAL INFORMATION

The Competition Commission has called for input by 3 March 2025 on draft guidelines intended to clarify confidentiality-related processes and procedures.

Once finalised, the proposed new guidelines are expected to assist any party claiming confidentiality over its information by providing insight into:

• the process of doing so effectively
• factors considered by the Commission when assessing a claim
• ‘regimes of access to confidential information’, and
• a claimant’s right to challenge a Commission decision.

The guidelines envisaged will also deal with access to confidential information, including the relevant legal principles.
