COMPETITION COMMISSION: INPUT SOUGHT ON TECHNICAL GOODS AFTERMARKET DRAFT GUIDELINES

Please note: 1) On 2 October 2026, the Commission gazetted a notice announcing the guideline’s finalisation, and referring stakeholders to their website for the document concerned. However, the guideline published there at the time was dated August 2026 and clearly marked 'draft'. The same applied to an accompanying background note. 2) The correct documents were eventually published shortly before close of business on 5 October 2026: final guidelines and background note. 3) On 6 September 2026, the Commission issued a media statement further elaborating on the new guidelines.

The Competition Commission has gazetted a notice calling for public comments by 21 September 2026 on draft guidelines for technical goods repair, service and maintenance aftermarkets.

According to the notice, the guidelines were developed with the aim of clarifying:

• how the Commission defines each relevant market and assesses its market power
• the categories of conduct and associated restrictions in each aftermarket with the potential to reduce or prevent competition, and
• ‘justifications … the Commission may consider’ when investigating and analysing complaints.
