COMPETITION COMMISSION: INPUT SOUGHT ON TWO DRAFT GUIDANCE NOTES

The Competition Commission has called for input draft guidelines for:

  • the pre-merger filing consultation process (24 November 2025 input deadline), and
  • online intermediation platforms (28 November 2025 input deadline).

Intended to be ‘voluntary, informal (and) non-binding’, the confidential pre-merger filing consultation process is expected to streamline merger transaction assessment by facilitating a discussion between the Commission and potential merger parties about issues likely to emerge and how best to resolve them.

Informed by the findings of a market inquiry concluded in 2023, the guidelines for online intermediation platforms are intended to assist with identifying and mitigating conduct likely to impede or prevent competition.
