COMPETITION COMMISSION RULES: BREACH OF MERGER APPROVAL CONDITIONS REPLACED

The Department of Trade, Industry & Competition has gazetted a notice announcing an amendment to the rules of the Competition Commission. Rule 39 (breach of merger approval conditions and obligations) has been replaced with immediate effect. This follows the release of draft amendments in May 2026 for public comment, as SA Legal Academy reported at the time.

Significantly more detailed than its original version, among other things, the new Rule 39 empowers the Commission to investigate – at any time – ‘whether a firm has breached a merger condition’.

It is not clear if the 2001 rules published on the Competition Commission website include previous amendments, if any.

  • Government Gazette notice with replacement Rule 39
  • 2001 Competition Commission rules (as published on its website)
