CONSTRUCTION: HEALTH & SAFETY REGULATIONS TO BE REPLACED?

Please note: On 13 March 2025, the national government website posted a backdated media statement in which, among other things, the department notes that by ‘redefining the scope of construction work’ the proposed new regulations seek to ensure that ‘more stringent requirements are placed upon the client, designer and contractors to prevent construction related incidents’.

The Department of Employment & Labour has gazetted construction industry-specific draft health and safety regulations for comment by 12 June 2025. This is with the intention of replacing regulations in force since February 2014 under the 1993 Occupational Health & Safety Act.

Although the department has issued a media statement on the proposed new regulations, at the time of writing it was inaccessible. A line-by-line comparison is therefore needed to identify the most significant changes now envisaged.
