CONSUMER PROTECTION COMMISSION: INPUT SOUGHT ON OPT-OUT REGULATORY GUIDELINES

The Consumer Protection Commission has gazetted draft guidelines on compliance with opt-out registry regulations under the 2008 Consumer Protection Act. The deadline for input is 17 October 2026.

The 2011 opt-out registry regulations were amended in April 2026, as SA Legal Academy reported at the time. Operationalising the opt-out registry, the amendments also introduced:

  • requirements relating to direct marketer:
    • registration
    • renewal
    • database cleansing, and
    • compliance with pre-emptive blocks, as well as
  • the identification of direct marketers, and
  • prescribed fees.

An April 2026 Consumer Protection Commission media statement provides further insight.
