The 2021 Correctional Services Amendment Act will come into effect on 1 February 2025. This has been confirmed by notice in the Government Gazette. Once in force, the amendments concerned will align the principal statute with the requirements of a Constitutional Court ruling on parole and correctional supervision. Handed down in May 2019 and popularly known as ‘the Phaahla judgment’, the ruling focused on the minimum periods to be served by a sentenced offender before becoming eligible for release on various forms of parole and supervision.
