CORRECTIONAL SERVICES AMENDMENT BILL RECTIFYING ACT'S UNCONSTITUTIONAL SECTIONS NOW AVAILABLE

The Correctional Services Amendment Bill formally introduced in Parliament 2 June 2023 is now available.

As SA Legal Academy has already reported, the Bill seeks to respond to:

  • a December 2020 Constitutional Court ruling that ‘sections 88A(1)(b) and 91 of the principal Act are constitutionally invalid to the extent that they fail to provide an adequate level of independence to the Judicial Inspectorate for Correctional Services’, and
  • ‘make further provision for the custody of all inmates under conditions of human dignity’.

This is according to a memorandum on the Bill’s objects.
