COURT PROCEEDINGS: AMENDMENTS PROPOSED FOR INFORMATION ACCESS RULES

The Rules Board for Courts of Law has called for input by 1 November 2024 on proposed amendments to the 2019 rules of procedure reflecting obligations under the Promotion of Access to Information Act, 2000. This follows a comprehensive review, the outcome of which is a revised set of rules among other things:

  • inserting definitions of certain words and phrases
  • replacing ‘High Court Rules’ with ‘Uniform Rules of Court’
  • affecting the use of a notice of motion
  • affecting the content of an affidavit or affirmation
  • inserting a rule to deal with condonation
  • amending the rule on ex parte representation, and
  • inserting a rule to regulate appeals.
