COURTS OF LAW: MORE CONDUCT OF PROCEEDINGS RULES AMENDED

On behalf of the Rules Board for Courts of Law, the Department of Justice & Constitutional Development has gazetted amendments to various sets of rules on the conduct of proceedings.

Effective from 3 July 2026, amendments to the Magistrates’ Courts rules affect:

  • the appointment of physical addresses
  • security for costs, and
  • a raft of related forms.

In force from 3 July 2026, amendments to rules on the conduct of proceedings in the provincial and local divisions of the High Court were gazetted under two separate notices.

The amendments attached to one notice affect:

  • the process for summoning an accused to answer any indictment, including:
    • the service of a subpoena
    • the contents of a subpoena, and
    • related forms.

Amendments attached to the other notice focus on security for costs.
