CRIMINAL LAW (FORENSIC PROCEDURES) AMENDMENT ACT IN FORCE SOON

The Criminal Law (Forensic Procedures) Amendment Act, 2022, will come into force on 3 March 2023 by presidential proclamation in the Government Gazette. This will enable the authorities concerned to take a buccal/saliva sample from anyone convicted of and serving a sentence for committing a Schedule 8 offence. More specifically, from 3 March it will be possible to enforce the legal obligation of such people to submit to the procedure entailed.

Schedule 8 offences are listed on pages 194 and 195 of the amended Criminal Procedure Act, having been added by section 5 of the Criminal Law (Forensic Procedures) Amendment Act, 2013. They include public violence, murder, rape and various offences under the Criminal Law (Sexual Offences & Related Matters) Amendment Act, 2007.
