CRIMINAL LAW: SALRC CALLS FOR INPUT ON TWO MORE DISCUSSION DOCUMENTS

As part of an ongoing review of the 1977 Criminal Procedure Act, the South African Law Reform Commission has called for input by 15 May 2026 on two more discussion documents focusing on:

  • the right to a fair trial (including ‘the need to obviate delays’), and
  • evidence in criminal proceedings.

In the context of the broader criminal law review process, the two latest papers follow five released in February 2026 – which, in turn, followed four published a year earlier, as SA Legal Academy has already reported.

According to an accompanying media statement, together the two new papers explore:

  • strengthening the legislative framework to:
    • ‘avert Stalingrad tactics’, and
    • ‘enable judicial officers to exercise effective … case management across the different stages of … criminal proceedings, and
  • ensuring that the law of evidence relating to criminal proceedings is:
    • ‘consistent with the constitutional right to a fair trial’, and
    • protects the rights of accused persons, the victims of crime and witnesses.
