CRIMINAL PROCEDURE ACT REVIEW: TWO MORE DISCUSSION PAPERS OUT FOR COMMENT

The South African Law Reform Commission has released two more discussion papers as the next step in its ongoing review of the 1977 Criminal Procedure Act. According to an accompanying media statement, they are the last two papers in the series – marking the conclusion of the review’s research phase. The deadline for input is 30 October 2026.
Focusing on the detention of witnesses and the payment of witness fees, Discussion Paper 182 explores the constitutionality of related provisions in the Act.
Discussion Paper 183 unpacks ‘South Africa’s obligations to respect, protect, ensure and promote language rights’ in the context of the constitutionally enshrined right to a fair trial.
