CRIMINAL PROCEEDINGS: CHANGES PROPOSED FOR MAGISTRATES’ COURTS RULES ON WITNESSES, SUBPOENAS

The Rules Board for Courts of Law has called for input by 31 July 2024 on draft amendments to Magistrates’ Courts Rule 64, which deals with criminal cases and related proceedings.

According to the notice concerned, the changes envisaged seek to address a ‘potential problem’ in implementing ‘certain provisionsin an earlier amendment to Rule 64 (procedure for securing witnesses’ attendance in criminal cases), which was gazetted on 12 May 2023 and came into force the following month.
