CYBERCRIMES ACT: SEARCH AND SEIZURE OPERATING PROCEDURES PUBLISHED

The Department of Police has gazetted a notice on the availability of a document prescribing standard operating procedures for conducting investigations and searches under the Cybercrimes Act, 2020 – as well as accessing and seizing articles.

This may be indicative either of the Act’s imminent commencement or of a proclamation declaring certain sections effective.

Signed into law in June 2021, among other things the Cybercrimes Act:

  • creates offences of activities with ‘a bearing on cybercrime’
  • criminalises the disclosure of harmful data messages
  • provides for interim protection orders, and
  • further regulates:
    • jurisdiction in respect of cybercrimes, and
    • measures relating to mutual assistance when investigating cybercrimes.
