DIVORCE AMENDMENT BILL: PUBLIC PARTICIPATION PROCESS BEGINS

Please note: On 1 September 2023, the Parliamentary Monitoring Group published a notice extending the deadline for written submissions by one week – to 15 September 2023.

The National Assembly’s Justice & Correctional Services Committee has called for written submissions by 8 September 2023 on the Divorce Amendment Bill. This is according to notices posted on Parliament’s website as well as by the Parliamentary Monitoring Group.

As SA Legal Academy reported when the Bill was tabled in July 2023, once passed, enacted and operationalised this new piece of legislation will extend the application of the Divorce Act, 1979, to Muslim marriages. Among other things, this is expected to ensure that, should such a marriage be dissolved:

  • the interests of dependent and minor children are safeguarded, and that
  • assets are redistributed appropriately.

The Bill should not be confused with a piece of proposed new legislation with the same title and overarching objectives, which was tabled in December 2022 by Al Jama-ah leader Ganief Hendricks.
