DIVORCE AMENDMENT BILL READY TO BE PASSED BY THE NCOP

The NCOP’s Security & Justice Committee has tabled a report in the House recommending that it adopt the Divorce Amendment Bill without any changes.

Formally introduced in July 2023 and passed by the National Assembly four months later, once operationalised the Bill is expected to ensure that:

  • the interests of a Muslim marriage’s dependent and minor children are safeguarded and protected, and that
  • on the dissolution of a Muslim marriage (where the husband is spouse in more than one union):
    • the assets are redistributed fairly, and
    • patrimonial benefits are forfeited ‘on the same terms’ as other dissolved marriages involving that spouse.
