Al Jama-ah leader Ganief Hendricks has tabled a Divorce Amendment Bill in the National Assembly.
If passed by Parliament, the Bill will provide for mechanisms to safeguard the welfare of minor or dependent children born of Muslim marriages; the redistribution of assets on the dissolution of a Muslim marriage; and for the forfeiture of the patrimonial benefits of a Muslim marriage.
In Hendricks’ view, as an interim measure, this would respond to a raft of court injunctions pending the conclusion of a decades-long process that has yet to arrive at a legal solution to the indignities suffered by Muslim wives and children married in terms of the Shariah law.
