DRUGS & DRUG TRAFFICKING AMENDMENT ACT GAZETTED

Immediately in force, the Act remedies the constitutional invalidity of section 63 of the principal statute, which erroneously delegated plenary legislative power to the Minister to amend the schedules. A Constitutional Court ruling handed down on 18 December 2020 gave Parliament two years to make the necessary amendments. These included changing Schedules 1 and 2 to reflect any substances added or removed by the Minister before the ruling. Schedule 1 lists substances useful for manufacturing drugs, while Schedule 2 lists dependency-producing substances.
