ECONOMIC REGULATION OF TRANSPORT: AMENDMENT BILL SIGNED INTO LAW

The Economic Regulation of Transport Amendment Bill passed by Parliament in December 2025 has been signed into law – correcting an error in Schedule 1 to the 2024 principal statute.

Once fully in force, the 2024 Economic Regulation of Transport Act will establish two parallel independent but integrated regulatory agencies dealing with road, rail, port and aviation services:

  • a Transport Economic Regulator responsible for:
    • stakeholder education
    • research
    • price control approval
    • access request approval
    • investigating complaints, and
    • enforcement, and
  • a Transport Economic Council as an adjudicative entity.

According to a presidential proclamation gazetted in November 2024, some sections and chapters of the principal statute commenced on 1 April 2025 – while others are scheduled to come into effect on 1 April 2026.
