ELECTORAL AMENDMENT ACT IN FORCE

The Electoral Amendment Act, 2023, came into effect on 19 June 2023. This was confirmed three days later by proclamation in the Government Gazette.

The Act allows independent candidates to stand for election to seats in the National Assembly and provincial legislatures. With that in mind, among other things the new piece of legislation also prescribes the conditions to be met and procedures followed.

In addition, the Act requires that – within four months of its commencement – the Minister should establish an Electoral Reform Consultation Panel ‘to independently investigate, consult on, report on and make recommendations in respect of potential reforms of the electoral system … in respect of elections to be held after the 2024 elections’.

In anticipation of this, on 19 May 2023 Home Affairs Minister Aaron Motsoaledi gazetted a notice calling on members of the public to nominate potential candidates for appointment to the panel.
